Neutral Citation No. - 2025:AHC:59426-DB Court No. - 44 Case :- CRIMINAL MISC. WRIT PETITION No. - 22980 of 2024 Petitioner :- Gyanchand Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Sudhir Kumar Counsel for Respondent :- G.A. Hon'ble Siddhartha Varma,J. Hon'ble Ms. Nand Prabha Shukla,J. Heard learned counsel for the petitioner, learned AGA for the State, learned counsel for the respondent no. 3 and perused the material available on record. When there was a discord between the petitioners and respondent no. 3, a First Information Report was lodged which gave rise to Case Crime No. 261 of 2024 under Sections 191(2), 64, 127, 351(2) B.N.S. at Police Station Parikshitgarh, District Meerut. To challenge the First Information report dated 05.11.2024, the petitioner had filed the instant writ petition wherein the Court had referred the matter to the Mediation Centre at Allahabad. Parties have thereafter amicably settled their disputes. The paragraph 7 of the settlement/agreement as was drawn by the mediator on 11.3.2025 is being reproduced here as under:
"a) That both the parties have already settled their dispute and in this regard they have produced a photocopy of a 'Notarized Affidavit' dated 19.12.2024 before this Centre. The parties stated that all the terms and conditions mentioned in
the aforesaid Affidavit have been fulfilled. The parties further reiterate and reaffirm all the terms and conditions of the aforesaid affidavit and the same shall be a part of this settlement also. The photocopy of the aforesaid sulahnama is being annexed herewith for kind perusal of this Hon'ble Court. The parties also stated that the aforesaid 'Affidavit' dated 19.12.2024 has already been submitted before this Hon'ble Court.. b) That it has also been agreed between the parties that all the cases filed by them against each other regarding present dispute shall be withdrawn by the parties concerned by taking appropriate steps before the Court/authority concerned. c) That the parties will not file any fresh case against each other in respect of this dispute. They have no claim against each other in future also. d) That it has been agreed between the parties that they shall not violate the terms and conditions of this settlement otherwise the aggrieved party will be free to take legal recourse." As per Clause 7 of the mediation report, the parties had agreed to withdraw all the cases which had been initiated against each other.
Under such circumstances, no useful purpose would be served by continuing the criminal case against the petitioner. The First Information Report dated 05.11.2024 registered as Case Crime No. 261 of 2024 was lodged under Sections 191(2), 64, 127, 351(2) B.N.S., Police Station Parikshitgarh, District Meerut is thus quashed. The writ petition is allowed. It is made clear that if any charge-sheet etc. has been filed by the Police and has been forwarded to the Court then that would also stand quashed.
