Heard learned counsel for parties of both the writ petitions and perused the record. 2. Present writ petition has been filed by the petitioner inter-alia with the following prayers:- "(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent to implement the order dated 11.09.2024 passed by the District Basic Education Officer, Mainpuri regarding joining of the petitioner on the post of Assistant Teacher in the institution Shri Daya Nand Dev Swami Inter College Dalupur, Barnahal, District Maiinpuri. (ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent to pay regular salary regularly every month and also pay arrears of salary of the petitioner from December, 2022 to on wanrd within the specified period fixed by this Hob'ble Court. 3. Connected the present writ petition with Writ Petition-A No. 1126 of 2025 (Rajesh Babu Versus State of U.P. and others). 4. With the consent of learned counsel for parties, both the writ petitions are being disposed of by common judgment and order. 5. Present writ petition was filed by the petitioner for payment of salary to the petitioner on the post of Assistant Teacher. 6. Pursuant to the order passed by this Court dated 19.12.2024, personal affidavit has been filed by the respondent no.5-District Basic Education Officer, Mainpuri. It is stated in the aforesaid affidavit that after imposing single operation upon the institution in question, entire payment has been released in favour of petitioner. 7. In view of this matter, prayer has been made by Sri Sunil Kumar Srivastava, learned counsel for the petitioner that present writ petition has become infructuous. 8. The present writ petition is dismissed as having become infructuous. 9. Personal appearance of the respondent no.5-District Basic Education Officer, Mainpuri is exempted. Order Date :- 17.2.2025 T.S.
