The present Criminal Writ Petition under Article 226 of the Constitution of India has been filed on behalf of the Petitioner-Tajbar Singh, S/o Narendra Singh against the Respondents, particularly Respondent Nos. 3 and 4-Rajeev Kumar @ Rajeev Chutani S/o Loknath Chutani and Rozi Rani, W/o Rajneesh Kumar. 5. The present Petition has been filed with the following prayer: “(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 09.07.2025, registered as FIR No. 19 of 2025 for the offences punishable under Sections 106, 125(b) and 281 of the B.N.S., 2023 at Police Station Chamoli, District Chamoli.” 6. Today, the matter is listed for disposal of the Compounding Application (IA No. 01 of 2024, Paper No. 27), seeking permission to compound the offence on the ground that the parties have amicably resolved their disputes. The application has been duly 2025:UHC:8050 signed by all the parties and endorsed by their respective learned counsel-Mr. Raj Kumar Singh for the Petitioner, and Mr. Rajesh Pratap for Respondent Nos. 3 and 4. In support of the application, affidavits have also been filed by the parties. 7. Learned State Counsel vehemently opposes the Compounding Application, submitting that the offences in question are non-compoundable. 8. The complainant/Respondent No. 3-Rajeev Kumar @ Rajeev Chutani, husband of the deceased Khushi Chutani, and one Rajneesh Kumar, husband of injured Rozi Rani, are present in person before this Court. Respondent No. 4—Rozi Rani is present through video conferencing. They all are duly identified by Mr. Rajesh Pratap, Advocate. Upon interaction, the complainant-Rajeev Kumar alias Rajeev Chutani states that the incident occurred at a dark place when they were crossing the road, resulting in the accident. He further submits that though he lodged the complaint against the Petitioner (driver of the vehicle) for rash and negligent driving, which caused injuries to Respondent No. 4 and the death of his wife, he admits that the incident was accidental and that there was fault on either side as they were crossing the road at the time. 9. The Petitioner—Tajbar Singh, is also present in person before this Court and has been duly identified by Mr. Raj Kumar Singh, Advocate. 10. Admit. 11. After interacting with the parties, this Court is 2025:UHC:8050 satisfied that a genuine compromise has been arrived at between them. The Court also finds that the statements of the complainant and the injured were made voluntarily, without any duress or pressure. 12. Considering the facts and circumstances of the case, the Compounding Application is allowed. The compromise between the parties is accepted. Consequently, FIR No. 19 of 2025, under Sections 106, 125(b) and 281 of the B.N.S., 2023, P.S. Chamoli, District Chamoli, is hereby quashed insofar as it relates to the present Petitioner, in terms of the compromise. 13. The Criminal Writ Petition stands disposed of accordingly. 14. All pending applications, if any, also stand disposed of.
