Instant writ petition was filed on behalf of petitioners way back on 22.01.2013, raising an issue that the merit list for the post of Teacher Grade-III pursuant to the advertisement dated 24.02.2012 has been prepared without following the ‘Roster Point’ of reservation in the recruitment in time bound manner and periodically, hence it was prayed that a fresh merit list be directed to be prepared and petitioners be accorded appointment on the post of Teacher Grade-III in their respective subjects in the concerned district. 2. Counsel for the petitioners, having instructions from the petitioners, submits that during the course of this writ petition, fresh vacancies have been notified and with passage of time, the prayer for appointment of petitioners pursuant to the advertisement dated 24.02.2012 has rendered infructuous, however the law point in respect of preparing the Rosters in all services for reservation in the recruitment in time bound manner and periodically, remain alive to be considered on merits. Hence, the prayer of counsel for the petitioners is that the writ petition may be disposed of as withdrawn, keeping the legal issue open to be taken up and considered on merits in any other writ petition as and when raised. 3. Taking into consideration the contention of counsel for the petitioners, the writ petition as far as the prayer to grant appointment to the petitioners is rendered infructuous, however the legal issue raised herein, shall remain open to be considered on merits, if occasion so arise.
