The present application u/s 528 of B.N.S.S. has been filed with prayer to issue a direction to Judicial Magistrate-III, Ghazipur, to decide the Case No. 2018 of 2015 (State vs. Amerika and others), arising out of Case Crime No. 955 of 2003, under Sections 323, 325, 504, 506 of I.P.C., P.S. Nandganj, District Ghazipur, within a stipulated period. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of B.N.S.S. is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
