CRP(PD).No.5323 of 2024 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 04.04.2025 CORAM THE HONOURABLE Ms. JUSTICE P.T. ASHA CRP.(PD).No.5323 of 2024 V.Shyamala ... Petitioner Vs. V.R.Gopi ... Respondent Prayer:- Civil Revision Petition is filed under Article 227 of the Constitution of India to set aside the order dated 11.01.2024 passed in FCIA No.3/2023 in FCOP.No.276/2022, by the learned Judge, Family Court, Chengalpet, in respect of quantum and enhance the amount as prayed in the maintenance petition, by allowing the CRP. For Petitioner : M/sM.Vijaya Ragavan For Respondent : Sole respondent – served -No appearance O R D E R 1/4 https://www.mhc.tn.gov.in/judis CRP(PD).No.5323 of 2024 Challenging the meager monthly maintenance that has been awarded to her, the petitioner/wife is before this Court. 2. The respondent though served has not entered appearance either in person or through a counsel. 3. On hearing the counsel for the petitioner/wife and on perusing the records, it is seen that the respondent/husband is now taking care of the child. The learned Family Court Judge, Chengalpet after observing that the petitioner/wife is seriously ill and that it is the bounden duty of the respondent/husband to maintain her, has only awarded a monthly maintenance of Rs.3,000/-, which would not even cover the petitioner’s basic needs, leave alone medical exigencies. 4. Therefore, considering the fact that the respondent/husband is employed and earning over a sum of Rs.14,000/- per month, which definitely would have increased now and also considering the fact that the respondent/husband has admittedly taken care of the petitioner’s medical condition by pledging her own jewels, it would be appropriate 2/4 https://www.mhc.tn.gov.in/judis CRP(PD).No.5323 of 2024 to enhance the monthly maintenance. Therefore, the Civil Revision Petition is allowed and the interim maintenance is enhanced from a sum of Rs.3,000/- to a sum of Rs.6,000/- per month.
