Neutral Citation No. - 2025:AHC:12432 Court No. - 10 Case :- WRIT - A No. - 19902 of 2024 Petitioner :- Govind Narayan Singh Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Samarath Singh,Sankalp Narain Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J. 1.Heard Sri Anil Mishra, holding brief of Sri Samarath Singh and Sri Sankalp Narain, learned counsel for the petitioner and Sri Shailendra Singh, learned Standing Counsel.
2. Petitioner is trying to reopen a dispute which has already been settled vide order dated 18.3.2009 passed by the DIOS Mirzapur, whereby his claim for salary was rejected and which remained unchallenged for more than a decade.
3. An attempt was made before the concerned State respondent that though he was successful to some extent that an order for fresh consideration was made. However, again it was rejected by the order dated 16.10.2023 as no case was made to revisit the above order after a decade.
4. Learned counsel for the petitioner submitted that petitioner is tying to reagitate his claim. However, State respondent kept silent despite repeated representations.
5. Learned Standing Counsel has supported the impugned order.
6. I have considered the above submissions.
7. As referred above, claim of the petitioner has already been rejected on 18.3.2009, which remained unchallenged for more than 15 years. There is no substantial material that petitioner was regularly trying to place his case before the said respondent. He has now approached this Court again for ventilating his grievance. Therefore, I don't find any error in the impugned order dated 16.10.2023, since the petitioner is now agitating a claim which can be termed as a 'stale claim' since it has not only been raised after one and half decade, but the Court cannot consider the challenge to the order dated 18.3.2009 only on a ground that now the prayer to revisit it is rejected recently.
8. Writ petition is accordingly dismissed. Order Date :- 24.1.2025 SB Digitally signed by :- SANDEEP BHATTACHARYA High Court of Judicature at Allahabad
