The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Criminal Case No.1388 of 2023, “State vs. Mandeep Kaur and Another”, pending before the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar under Section 387 and Section 120B of the Indian Penal Code, 1860. 2. The applicant – accused Mandeep Kaur is present in-person before this Court. She is identified by Ms. Aishwarya Thapliyal, Advocate. The vakalatnama, 1 2025:UHC:8088 filed by Ms. Aishwarya Thapliyal, Advocate, is taken on record. 3. The respondent no.2 - informant – victim is present in-person before this Court. He is identified by Mr. Abhishek Verma, Advocate. 4. Heard Ms. Aishwarya Thapliyal, learned counsel for the applicant, Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1 and Mr. Abhishek Verma, learned counsel for the respondent no.2/informant – victim. 5. According to the prosecution, a threat was received on the mobile phone of the respondent no.2 from mobile phone no.447424096704. The caller was demanding ransom of Rs.1.00 crore. 6. The applicant- accused is the wife of the respondent no.2. 7. The applicant and the respondent no.2 submitted that they are living together happily. They have filed a Compounding Application (IA No.01 of 2025) and affidavits with their free will and without any pressure. 2 2025:UHC:8088 8. The respondent no.2 has requested to quash the entire proceedings of Criminal Case No.1388 of 2023 qua the applicant – Mandeep Kaur. 9. The said request has not been opposed by the respondent no.1. 10. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.1388 of 2023, “State vs. Mandeep Kaur and Another”, pending before the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar, are quashed qua the applicant – Mandeep Kaur. 11. Resultantly, the present Application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and the entire proceedings of Criminal Case No.1388 of 2023, “State vs. Mandeep Kaur and Another”, pending before the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar, are hereby quashed qua the applicant – Mandeep Kaur. ___________________ ALOK KUMAR VERMA, J.
