IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3505] THURSDAY, THE THIRTEENTH DAY OF MARCH TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE T.C.D.SEKHAR WRIT PETITION NO: 6478/2025 Between: E. Eranna and Others ...PETITIONER(S) AND The State Of Andhra Pradesh and Others ...RESPONDENT(S) Counsel for the Petitioner(S):
1. N ASWARTHA NARAYANA Counsel for the Respondent(S):
1. GP FOR REVENUE
2
The Court made the following order:
The present Writ Petition is filed questioning the action of the respondents in trying to alter the revenue entries made in respect of land admeasuring Ac.5.00 cents situated in Sy.No.480/2 at Kammur Village, Kuderu Mandal, Ananthapur District, without following the procedure contemplated under law. 2. The 1st petitioner’s father purchased the subject land by virtue of a registered deed dated 02.08.1967, and since then, he was in peaceful possession and enjoyment of the subject land until his demise. He had two sons i.e., the 1st petitioner and the husband of the 2nd petitioner. After the death of the 1st petitioner’s father, the subject property devolved equally on the 1st petitioner and the husband of the 2nd petitioner. It is further case of the petitioners that their names were also mutated in the revenue records, and they have been in possession and enjoyment of the subject lands. While things stood thus, the 4th respondent, without issuing any notice, asked the petitioners to sign on consent papers so as to enter the names of respondent Nos.5 to 10 in revenue records over the subject property. Questioning the said action of the respondents, the present writ petition is filed. 3
3. Heard learned counsel for the petitioners and learned Assistant Government Pleader for the Revenue. 4. The learned Assistant Government Pleader for Revenue submitted the written instruction dated 13.02.2025, furnished by the Tahsildar, kuderu, and on perusal of the same, it is clear that the petitioners filed a suit vide O.S.No.89 of 2012 on the file of Principal Civil Judge (Senior Division), Ananthapuram. Upon dismissal of the said suit, the unofficial respondents made an application to the respondents seeking to mutate their names in the revenue records over the subject land. Thereupon, the 4th respondent issued notice in Form-8 to the petitioners calling for objections, if any, in the matter. Without submitting the objections, the petitioner approached this Court by filing the present writ petition.
The said written instructions are placed on record and have drawn the attention of this Court to the same. 5. In reply, learned counsel for the petitioners submits that they did not receive any notice, as alleged by the respondents. 6. Taking the submissions into consideration, this Court is inclined to dispose of the present writ petition at the stage of admission with the following order:
4
The 4th respondent is directed to issue notice afresh to the petitioners. Upon service of the said notice, the petitioners are
directed to submit their explanation and thereafter the 4th respondent to pass appropriate orders by affording an opportunity of being heard to both the parties. It is needless to mention that, till appropriate orders are passed, status-quo existing as on today in respect of the entries in revenue records shall be maintained.
7. Accordingly, the Writ Petition is disposed of. There shall be no
order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed. _______________ T.C.D.SEKHAR,J Date: 13.03.2025 ANS
