Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. The writ petition has been filed with the following prayer: "(i) Issue a writ order or direction in the nature of certiorari to quash the impugned order dated 21.03.2024 passed by Deputy Labour Commissioner/Prescribed Authority, Payment of Wages Act, Bareilly under the payment of wages Act, 1936 as well as citation dated 06.08.2024 issued by Tehsildar, Tehsil Amariya for recovery of Rs.1,14,000/-. (ii) Issue a writ order or direction in the nature of Mandamus Commanding/Directing the Respondents authority not to recover the alleged amount from the petitioner during the pendency of the present writ petition in this Hon'ble Court. (iii) Issue a writ order or direction in the nature of Mandamus Commanding/Directing the Respondents Specially Respondent no. 2 to decide the recall application dated 13.09.2024." 3. Learned counsel for petitioner submits that against the order dated 21.3.2024, petitioner has filed recall application dated 13.9.2024 as the order has been passed ex parte against petitioner. During pendency of the same, recovery proceedings have been initiated against petitioner. It is submitted that recall application may be decided in a time bound manner. 4. Considering the facts and circumstances of the case, it is hereby provided that recall application dated 13.9.2024 filed by petitioner be decided expeditiously by respondent no.2, in accordance with law, preferably within a period of one month from the date of production of a certified copy of the order. 5.
