The petitioner has preferred the present petition with the prayer to direct the respondent nos. 2 and 3 to stop the Gram Panchayat Building being constructed on the petitioner's land, Arazi No. 239 area 0.1140 hectare and the land reserved for the Gram Panchayat Building is Arazi No. 237 area 0.197 hectare, on the same land the respondent should get the gram Panchayat Buliding constructed. 2. Pursuant to order passed by this Court instructions dated 12.02.2025 under the signatures of Sub Divisional Magistrate, Tehsil Jakhaniya, District Ghazipur placed before this Court, the same is taken on record. 3. It is stated in the aforesaid instructions that in village Ramban Pargana Shadiyabad, Tehsil Jakhaniya, District Ghazipur plot no. 237 area 0.197 hectare is mentioned in the name of Panchayat Bhawan and gata no. 239 area 0.1140 hectare is mentioned in the name of petitioner. It is further stated that land in question was duly demarcated in the presence of Regional Revenue Officer, Lekhpal alongwith Village Pradhan and other villagers and it was found that the Panchayat Bhawan was constructed on its original place and there is no encroachment on the land being gata no. 239 area 0.1140 hectare. The aforesaid instructions is quoted below:- "गग्राम रग्रामबन परमनग्रा शग्राददियग्राबग्रादि तहससील जलदनयग्राय, जनपदि गग्राजसीपपुर ससस्थित गग्राटग्रा सय0 237 रकबग्रा 0.197 हहे० रग्राजसव अदभिलहेख पयचग्रायत भिवन कहे नग्राग व गग्राटग्रा सय० 239 रकबग्रा 0.1140 हहे० रग्राजसव अदभिलहेख मम रग्रामहरख पपुत्र ससीमग्रारग्राम कहे नग्राम सयक्रमणसीय भिभूदमधर कहे गग्राम अदकत हहै। गग्राटग्रा सय० 237 रकयग्रा 0.1970 हहै० पयचग्रायत भिवन कहे ससीमग्रायकन हहेतपु ददिनग्राक 10.02.2025 कको कहेत्रसीय रग्राजसव दनरसीकक, लहेखपग्राल व गग्राम प्रधग्रान तस्थिग्रा गग्रामवग्राससययों ककी उपससस्थिदत मम ससीमग्राकन दकयग्रा गयग्रा। ससीमग्रायकन मम पग्रायग्रा गयग्रा दक पचग्रायत भिवन अपनहे मभूल गग्राटग्रा पर दनदमरत हहै। गग्राटग्रा सय० 239 रकबग्रा 0.1140 हहे० पर रग्रामहरख पपुत्र ससीतग्रारग्राम दनवग्राससी गग्राम रग्रामवन परगनग्रा शग्राददियग्राबग्रादि तहससील जग्रादनयग्रा जनपदि गग्राजसीपपुर कग्रा पभूवर सहे कब्जग्रा हहै। पयचग्रायत भिवन कग्रा दनमग्रारण यग्राचसी कहे आरग्राजसी मम नहहीं हहआ हहै। (सयलग्नक ममौकहे सपग्राट महेगको व फकोटकोगग्राफ)" 4. After going through the same the court is of the opinion that the Panchayat Bhawan has been constructed on a different land which does not belong to the petitioner hence the present petition is totally misconceived, the same is liable to be dismissed and is hereby dismissed.
