Order No.02 Dated- 01.05.2025
Heard the parties. The petitioners have moved this Court for grant of bail in connection with N.D.P.S. Case No. 10 of 2022 (A) arising out of Murhu P.S. Case No.19 of 2022 registered for the offences punishable under sections 8/18/25 of the N.D.P.S. Act. The learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners were involved in cultivation of poppy. It is further submitted that the allegations against the petitioners are all false and the petitioners have been implicated in this case only on the basis of the confessional statement of the co-accused persons who have already been admitted to bail. It is then submitted that the petitioners have no concern with the place of occurrence land and the place of occurrence does not belong to them. It is next submitted that the petitioners have no criminal antecedent as has been mentioned in paragraph no.5 of the supplementary affidavit. It is then submitted that the petitioners have been in custody since 17.01.2025 as has been mentioned in paragraph no. 01 of the bail application. It is next submitted that the petitioners undertake to cooperate with the trial of the case. It is lastly submitted that the co-accused persons have already been admitted to bail by this Court vide order dated
23.04.2025, in B.A. Nos. 3221 and 3227 of 2025. Hence, it is submitted that the petitioners be admitted to bail. The learned Addl. P.P. opposes the prayer for bail and submits that as per the FSL report, the sample seized from the field contained poppy straw but the quantum of cultivation has not been mentioned anywhere. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioners on bail.
Accordingly, the petitioners are directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.S.J.-II, Khunti, in connection with N.D.P.S. Case No. 10 of 2022 (A) arising out of Murhu P.S. Case No.19 of 2022 with the condition that the petitioners will cooperate with the trial of the case and will furnish their mobile number and a copy of their Aadhar Card in the court below with the undertaking that they will not change their mobile number during the trial of the case.
