Heard learned Standing Counsel for the State-respondents and perused the record. 2. The instant writ petition has been filed for following relief: "1. To issue, a Writ, Order or direction in the nature of Mandamus Commanding the Respondent No. 2/Sub Divisional Officer, Tehsil Tamkuhiraj, district Kushinagar to decide the Proceeding of Case No. 10794 of 2022 (Sarajuddin Vs. Imamuddin and Others) "Computerized Case No. C-202205440310794" Under Section 116 of Uttar Pradesh Revenue Code 2006 Mauja Bhatwaliya, Tappa Dhuriya Vijaypur, Pargana Sidhuwa Jobna, Tehsil Tamkuhiraj, district Kushinagar, Pending before it expeditiously, within a Period so stipulated by this Hon'ble Court. So that Justice may be done with the Petitioner." 3. From perusal of the writ petition and annexures annexed thereto, it appears that the aforementioned case is pending since 2022 before respondent no.2 for adjudication. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the respondent No. 2, Sub Divisional Officer, Tehsil-Tamkuhiraj, district-Kushinagar to consider and decide the aforementioned case in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned and after giving a reasonable opportunity of leading evidence in respect of their case provided that there is no other legal impediment.
