( 2025:JHHC:13237 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 3327 of 2025 ------ Karam Singh Oreya @ Karma Singh Oreya, aged about 46 years, S/o Mangal Oreya, R/o village –Barkela, P.O. – Sarwada, P.S. –Murhu, District –Khunti. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Amit Kumar, Advocate For the State : Mr. Pankaj Kumar, P.P. ------ Order No.02 Dated- 01.05.2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with N.D.P.S. Case No. 10 of 2022 (A) arising out of Murhu P.S. Case No.19 of 2022 registered for the offences punishable under sections 8/18/25 of the N.D.P.S. Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cultivation of poppy. It is further submitted that the allegations against the petitioner are all false and the petitioner has been implicated in this case only on the basis of the confessional statement of the co-accused persons who have already been admitted to bail. It is then submitted that the petitioner has no concern with the place of occurrence land and the place of occurrence does not belong to him. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.5 of the supplementary affidavit. It is then submitted that the petitioner has been in custody since 17.01.2025 as has been mentioned in paragraph no. 01 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case. It is lastly submitted that the co-accused persons have already been admitted to bail by this Court vide order dated 23.04.2025, in B.A. Nos. 3221 and 3227 of 2025. Hence, it is submitted that the petitioner be admitted to bail. The learned P.P. opposes the prayer for bail and submits that as per the FSL report, the sample seized from the field contained poppy straw but the quantum of cultivation has not been mentioned anywhere. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.S.J.-II, Khunti, in connection with N.D.P.S. Case No. 10 of 2022 (A) arising out of Murhu P.S. Case No.19 of 2022 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case.
