The father of the petitioner died in harness on 12.08.2023, 3. while he was in-service as driver with respondent-Corporation. The deceased is survived by wife and four daughters including the petitioner, who are all married. However, the petitioner’s family and her widowed sister namely A.Sasikala, were living with the deceased family. The petitioner has completed B.Tech in Electrical and Electronics Engineering. She made an application on 24.11.2023 to the 4*'^ respondent seeking compassionate appointment. The said application, in turn, has been forwarded to the 3^^^ respondent. The 3 3™ respondent by an endorsement dated 13.02.2024, has in turn, transmitted the application to the 5’^ respondent-District Collector, who is competent to consider the case of the petitioner for compassionate appointment. Learned counsel for the petitioner submits that though the 4. same was transmitted way back in the month of February, 2024 and even the Depot Manager has by proceedings dated 18.03.2024 endorsed the application along with necessary enclosures to the 3 respondent, no decision has been taken as of now. The petitioner being daughter of the deceased is entitled for consideration to be appointed on compassionate grounds and he would place reliance on judgment passed by the coordinate Bench of this Court in rd W.P.No.7059 of 2021. Learned Standing Counsel appearing for respondent Nos.1 to 5. 4 submits that the application of the petitioner has been forwarded respondent to the 3^^^ respondent- th by the Depot Manager-4 Personnel Officer, in turn, has transmitted the same to the 5 respondent-District Collector, who is competent to examine and decide such application, as the Corporation has now been merged th with the Government. # 4 r Learned Government Pleader for Services-ll appearing for 6. respondent No.5 submits that the application of the petitioner shall be considered in accordance with law. In view of the aforesaid submissions, without expressing any 7. opinion on the merits of the matter, the Writ Petition is disposed of, directing the 5*^ respondent to consider the application of the petitioner dated 24.11.2023, as transmitted by the 3"'^ respondent enclosing the annexures and required documents for the purpose of compassionate appointment, and pass speaking orders, in accordance with law, within a period of four (04) weeks from the date of receipt of a copy of this order.
