Neutral Citation No. - 2025:AHC:11594 Court No. - 5 Case :- WRIT - A No. - 20143 of 2024 Petitioner :- Sunita Devi Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Gyanendra Singh,P.K. Upadhyay Counsel for Respondent :- C.S.C.,Sheo Ram Singh Hon'ble Ajay Bhanot,J. Heard Shri P. K. Upadhyay, learned for the petitioner, Ms. Kritika Singh, learned counsel for the respondent no. 4 and 5,and Shri Sheo Ram Singh, learned counsel for the respondent nos. 2, 3, 4, 6. The petitioner claims that family pension to which the petitioner is entitled and Employees Provident Fund (EPF) of her deceased husband have not been disbursed to her. She has made a representation in this regard but to no avail. The only prayer made on behalf of the petitioner is that her representation may be decided within a stipulated period of time. Learned counsels for the respondents submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that service benefits/claim is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going
into the merits of the case, the respondent nos. 4 and 7 are directed to decide the representation of the petitioner for disbursal of various service benefits including family pension, gratuity, leave encashment, group insurance, arrears of pension as per law within a period of two months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. In case the amount is not paid within the aforesaid period, it is open to the petitioner to file a fresh writ petition. In that event the Court may fix appropriate costs on the concerned authorities. With the aforesaid direction, the writ petition is finally
disposed of.
