Neutral Citation No. - 2025:AHC:131078 Court No. - 5 Case :- WRIT - A No. - 20019 of 2024 Petitioner :- Smt Vimla Devi @ Vimla Bari Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Harindra Prasad Counsel for Respondent :- Abhishek Srivastava,C.S.C.,Sushil Kumar Pal Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri Harindra Prasad, learned counsel for the petitioner, Sri Abhishek Srivastava and Ms. Shakshi Srivastava holding brief of Sri Sushil Kumar Pal on behalf of respondents. 2. This Court has passed following order on 22.5.2025: "The husband of the petitioner died in harness on 09.09.1990. The petitioner was dependant on her husband. The counter affidavit filed on behalf of respondent no. 4 asserts that the son of the petitioner was granted appointment on compassionate grounds (this fact is absent in the writ petition). The son of the petitioner maintained her and took care of her interests in well being. Learned counsel for the petitioner orally submits that her son has also passed away and his wife has now been granted appointment on compassionate grounds. However, the daughter in law of the petitioner is not maintaining her nor taking care of her needs. These facts have also not been pleaded in the writ petition before the Court. Faced with this Shri Harindra Prasad, learned counsel for the petitioner prays for and is granted time to file an amendment applicant. Put up this matter on 05.08.2025 in the list of fresh cases." 3. Aforesaid order has not been complied with till date. 4. Prayer to grant family pension to the petitioner cannot be allowed after more than 3 decades since husband of the petitioner died wayback on 9.9.1990. 5. In the aforesaid circumstances, writ petition is dismissed. Order Date :- 5.8.2025 SB Digitally signed by :- SANDEEP BHATTACHARYA High Court of Judicature at Allahabad
