Captioned main 'Writ Petition' ['WP' for the sake of brevity] has been filed inter alia assailing an order dated 23.11.2024 bearing reference e/f/vz;/M1-10-2024 made by lone respondent' [hereinafter 'impugned order' for the sake of brevity]. 2. In and by the impugned order, the lone respondent has negatived writ petitioner's request for reclassification of land situate in 'Survey No.249, Injambakkam Village, Sholinganallur Taluk, South Chennai Revenue Division, Chennai' [hereinafter 'said land' for the sake of brevity]. 3. To be noted, prior to the impugned order, notice has been issued under 'The Tamil Nadu Urban Local Bodies Act, 1998 (Act 9 of 1999)' https://www.mhc.tn.gov.in/judis W.P.No.2828 of 2025 (hereinafter 'TNULB Act' for the sake of convenience and clarity), more particularly under Section 128(1)(b) and proceedings are underway. With regard to proceedings under TNULB Act, writ petitioner earlier came to this Court by way of W.P.No.34001 of 2024 and the same was disposed of in and by an order dated 14.11.2024. 4. As regards the aforementioned impugned order, learned counsel submitted that the impugned order has been made on the same day on which the application for reclassification was made. 5. Issue notice. 6. Mr.T.K.Saravanan, learned Government Advocate accepts notice for lone respondent. 7. Learned State counsel submits that the impugned order has been made based on records and therefore, the order being made on the same day cannot be found fault with. 8. We find that the writ petitioner as of today has not made any application vide sub-paragraph (viii) of paragraph 4 and there are no averments in the writ affidavit as to the writ petitioner satisfying the eligibility criteria qua sub-paragraph (viiii) of paragraph 4. Therefore, while sustaining the impugned order, we make it clear that if the writ petitioner makes an application in terms of sub-paragraph (viii) of Paragraph 4 of G.O.Ms.No.318, the authorities concerned shall consider the same on its own merits and in accordance with law (subject of course to eligibility criteria being satisfied). In other words, dismissal of this writ petition will not impede the writ petitioner resorting to sub- paragraphs (vii) and (viii) of paragraph 4 of aforementioned Government Order being G.O.Ms.No.318 dated 30.08.2019 and the authorities considering the same on its own merits and in accordance with law. https://www.mhc.tn.gov.in/judis W.P.No.2828 of 2025 Captioned writ petition fails and the same is dismissed albeit with aforementioned observations.
