1. The present petition has been filed by the petitioner under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (For short
“BNSS”) seeking regular bail in the FIR mentioned below:- FIR No. Dated Police Station Sections 24 18.09.2024 Punjab State Cyber Crime,

Brief facts relevant for the purpose of disposal of this petition are that the aforementioned FIR was registered on the basis of complaint lodged by the complainant Meenakshi Garg levelling allegations of being duped of an amount of approximately Rs.1,74,50,000/- while trading in shares online through platforms MANJU 2025.08.07 16:47 I attest to the accuracy and authenticity of this order /judgment Chandigarh
CRM-M No.1017 of 2025 -2- https://app.bekisj.com and https://lkrept.com that were promoted by a Whatsapp group operated through the guidance of Whatsapp accounts run by the administrators named as Professor Ankit Aggarwal and his assistant Meera. 3. After registration of FIR, investigation proceedings were initiated. It was revealed during investigation that the amount taken from the complainant was transferred to six different bank accounts by various transactions. Information about the Whatsapp group and its associated accounts was obtained and it was found that those accounts were operated from Combodia and the websites were used to build fake trading dashboard and were registered with Alibaba Cloud. The authorities of Alibaba cloud was directed to provide information. After following the money trail, it was revealed that an amount of Rs.30 lakhs was transferred from the account of the complainant in the account run in the name of one Nalini Marketing and from the said account, transfer of amount of Rs.10,80,000/- had been made in the bank account in the name of the petitioner as on 07.09.2024. The petitioner was nominated as an accused. She was arrested on 23.10.2024. 4. On interrogation, the petitioner disclosed that her cousin brother Prince Ghai and Gurpreet Singh had opened two accounts in her name by disclosing that there was an opportunity to earn money and by saying that she would get commission out of that money. They had also kept her cheque books. The co-accused Prince Ghai, Gurpreet Singh and Jasveer Kaur were also arrested subsequently. CRM-M No.1017 of 2025 -3- accused stands concluded and challan has been presented against them. 5. It is argued by learned counsel for the petitioner that she has been falsely implicated in this case. She was allured by her cousin brother i.e. co-accused Prince Ghai and had no intention to deceive anyone including the complainant and to commit offence of cheating. She is mother of three children.
The subject offences are triable by Magistrate. She is in custody since 23.10.2024. No purpose would be served by her further incarceration. She has permanent abode. She is not a flight risk. It is, therefore, argued that she deserves to be released on bail. 6. Status report has been filed. It is argued by learned Assistant Advocate General, Punjab that the allegations against the petitioner are serious in nature as in connivance with the co-accused, she had duped the complainant of a huge amount of money. There are chances of her absconding if extended benefit of bail. It is, therefore, urged that the petition does not deserve to be allowed. 7. This Court has considered the rival submissions. 8. The petitioner is alleged to be a part of conspiracy hatched with the co-accused, one of whom is his cousin brother Prince Ghai i.e. the co- accused, to deceive the complainant. She is in custody since 23.10.2024. She does not have any criminal antecedents. The subject offences are triable by Magistrate. Keeping in view the nature of the allegations and the part attributed to the petitioner coupled with the fact that apart from the transactions that had taken place on 07.09.2024, no other money from the MANJU 2025.08.07 16:47 I attest to the accuracy and authenticity of this order /judgment Chandigarh
CRM-M No.1017 of 2025 -4- account of the complainant was transferred in her account and since it is also revealed that the money transferred in her account had been transferred in some other accounts and the attendant facts and circumstances but without meaning to make any comment on the merits of the case, this Court is of the opinion that a case for release of the petitioner on bail is made out at this stage. Accordingly, the petition is allowed and the petitioner is ordered to be admitted to bail subject to her furnishing personal as well as surety bonds to the satisfaction of learned trial Court/CJM/Duty Magistrate concerned. She shall deposit her passport, if any, with the learned trial Court.
She shall not leave the country without prior permission of the trial Court. She will also disclose her present as well as permanent address before the learned trial Court at the time of furnishing of bonds and shall also give copy of her Aadhar Card, PAN Card if any and details of her mobile phone number(s) to the learned trial Court and in case, any change in her address or mobile phone number takes place, then she shall inform about the same to the learned trial Court in advance. 9. In the eventuality of breach of any of the aforementioned conditions, the respondent-State shall be at liberty to move an application seeking cancellation of the bail. (MANISHA BATRA) 07.08.2025
