CRMPM-2421 of 2025 By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant/petitioner for condonation of delay in maintaining the accompanying criminal revision petition, which is barred by limitation. Despite sufficient opportunities, no reply has been filed on behalf of non-applicant/respondent. Having carefully perused the averments contained in the application, which are duly supported by an affidavit, this Court finds no impediment in accepting the prayer, especially when delay caused in maintaining accompanying criminal revision petition does not appear to be intentional or willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant/petitoner, as such, the same deserves to be condoned. In view of above, delay, which has been otherwise sufficiently explained is condoned. The application is disposed of. Cr. Revision No. _______ of 2026 Admit. Notice. Mr. Ajay Singh Kashyap, Advocate, appears and accepts service of notice on behalf of the respondent. Learned counsel for the petitioner, on instructions, states that petitioner is ready and willing to settle the matter amicably. He states that though petitioner shall pay the compensation amount awarded by the learned Additional Chief Judicial Magistrate, Theog, District Shimla, Himachal Pradesh, but for that purpose, some reasonable time may be granted. Though petitioner may deposit the entire amount of compensation within six weeks, but sum of Rs.1,00,000/-, as directed to be deposited vide order dated 03.12.2025, shall be positively deposited within one week.
