5.
Learned counsel for the petitioner submitted that considering nature of allegations and that respondent no.3 has accepted his acts, he requires a major penalty and it is not a case of a minor penalty. 6. Learned counsel for the respondent no.3 submitted that since the respondent no.3 has extended a written unqualified apology, therefore without interfering with the impugned order, he may be given a chance to improve himself. 7. Learned Standing Counsel has supported the impugned order. 8. I have considered the above submissions and considering that the respondent no.3 is a Class IV employee who is working in the petitioner's College for more than two decades and has extended a
4 written unqualified apology, therefore, he is entitled for a chance to improve his conduct. However, in case a subsequent complaint is made against him or he commits any act of moral turpitude, in that concerned College which is a girls College, he can suffer a major penalty. 9. In order to ensure that respondent no.3 may not repeat such act, he should submit a written undertaking that he will do his work diligently and will not disturb other persons unnecessary and in case any trouble is created by him, petitioner's Committee of Management will be at liberty to even initiate a criminal proceeding against him alongwith disciplinary proceeding. 10. With the aforesaid observations/direction, this writ petition is
disposed of.
