Learned counsel for the petitioner(s) submits that keeping in view the latest judgment of the Hon’ble Supreme Court of India in Civil Appeal No.14831-2024 titled as Jaggo vs. Union of India and others, decided on 20.12.2024, the petitioner(s) intends to approach the respondents by way of filing a representation for the grant of benefit of reinstatement/regularization in service as well as minimum of the pay scale and prays that the respondents be directed to decide the said representation in a time bound manner by passing an appropriate speaking order. 2. Learned counsel for the respondents submits that in case, any AARTI SHARMA 2025.07.09 12:33 I attest to the accuracy and integrity of this document CWP-941-2021 (O&M) & -4- other connected cases representation is received from the petitioner(s), the same will be considered by the respondents keeping in view the settled principle of law in Jaggo (supra), as well as the service conditions governing the petitioner(s) and an appropriate speaking order will be passed within a period of 08 weeks from the date of receipt of any such representation and in case, the claim regarding reinstatement/regularization in service as well as the grant of minimum pay scale of the petitioner(s) is found to be genuine and is covered under the settled principle of law settled in Jaggo (supra), the said relief will be granted to the petitioner(s) otherwise, due reasons for not accepting the claim of the petitioner(s) will be mentioned in the speaking order so passed, which order will be conveyed to the petitioner(s) for their information and necessary action. 3. Learned counsel for the petitioner(s) submits that as some of the petitioner(s) are already continuing in service under the interim order of this Court hence, till the decision of the representation to be filed by the petitioner(s) , such petitioner(s) be allowed to continue in service. 4. Learned counsel for the respondents submits that in case, any representation is filed by the petitioner(s) within a period of 10 days from today, the petitioners, who have interim order in their favour, will be allowed to continue in service, till the decision of the said representation. 5. Learned counsel for the petitioner(s) submits that though, the petitioners were continuing in service but they have not been paid salary. 6. Learned counsel for the respondents submits that the said grievance will also be adjudicated in case the same is part of the representation to be filed by the petitioner(s).
