…...... 02/ 23.04.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 363, 366-A of IPC. 3. It is the allegation that the minor daughter of the informant was enticed by this petitioner, thereafter sexual intercourse had taken place. 4. After going through the impugned order, I find that learned Court concerned found from the case diary that statement of the girl was recorded at para 180, wherein she stated that she had voluntarily left her house and started working outside. She further stated that during the said period she came in contact with the petitioner and got married to him in Sherghati Court and she was blessed with a baby girl. It appears from paras 69 & 77 of the case diary that investigation on the point of the age of the victim is pending. In the statement recorded before the Magistrate, she stated her age to be 21 years. 5. Considering the fact that this fact has been narrated by the victim herself and has been reflected in the case diary which the Sessions Judge had also taken note of, I am inclined to allow this anticipatory bail application of the petitioner. 2025:JHHC:11973
6. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned Court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rs.
Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Palamau in connection with Hariharganj P.S. Case No.10 of 2022 subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
