The petitioner has preferred the present writ petition with the following prayers:- " A writ order or direction in the nature of mandamus directing the respondent no. 2 (Sub Divisional Magistrate, Tehsil Tamkuhiraj, District Kushinagar) to consider and decide the Case No. 1538/2024 computerize Case No. T-202405440301538 (Durga and others Vs. Sunil and others) under section 134 of U.P. Revenue Code 2006. which is pending since 28.09.2021." 2. Pursuant to the order passed by this Court, a personal affidavit has been filed by respondent no. 2 on 03.01.2025. It is stated in the aforesaid affidavit that decision in the matter has already been taken on 27.12.2024, copy of which is appended as Annexure No. P.A. 5 to the said affidavit. 3. Heard learned counsel for the parties and perused the record. 4. In the facts and circumstances of the case, the Court is of the opinion that the relief sought by the petitioner has already been granted, therefore, no further order is required to be passed in the matter and the petitioner has now become infructuous. 5.
