(2) Petitioner served as Gardner in Nagar Palika Parishad, Nainital and she retired on 30.11.2023. According to her, her retiral dues have not been released so far. By means of this writ petition, she has sought the following relief:- “(a) To issue a writ, order or direction in the nature of Mandamus commanding and directing the respondents to forthwith release the amount of gratuity, leave encashment and arrear of pension to the petitioner along with the interest @ 18% per annum.” (3) Mr. B.S. Bisht, learned Counsel appearing for the Nagar Palika Parishad, on instructions, submits that Nagar Palika Parishad admits its liability to pay the gratuity and leave encashment to petitioner. He, however, submits that due to financial constraint faced by Nagar Palika Parishad, some time would be needed for releasing the amount. (4) In view of the admission made by Nagar Palika Parishad, writ petition is disposed of with a direction to respondent no. 4 to release the amount of gratuity to petitioner within two months and amount of leave encashment and other retiral dues, if any, within five months from the 2025:UHC:8063 date of presentation of certified copy of this order. (5) State Government shall consider the request made by Nagar Palika Parishad for release of fund, as per law, as early as possible.
