The present application has been preferred for quashing of the NBW dated 17.10.2024 and proceeding under Section 82 Cr.P.C. passed by the Additional Chief Judicial Magistrate, Court No.16, Prayagraj in Case No.382 of 2008, (State versus Unknown), arising out of Case Crime No.633 of 2007, under Section 147, 148, 336, 341, 504 IPC and Section 7 Criminal Law Amendment Act, Police Station Dhoomanganj, District Prayagraj pending in the Court of Additional Chief Judicial Magistrate, Court No.16, Prayagraj and permit the applicant to appear in the proceedings through counsel. 3. Since the applicant had already been extended bail by surrender before the learned Court concerned and as such proceeding initiated in pursuance to NBW issued by concerned Court which culminated into proceedings under Sections 82 and 83 Cr.P.C. but once the applicant has already been surrendered and extended bail no cause of actions available in favour of the applicant to challenge the proceeding arising in pursuance to NBW issued against the applicant in lieu of non appearance. 4. Cause for filing instant application rendered infructuous and as such the instant applicant is hereby dismissed as infructuous.
