[1] Heard Ms. Sillori L, learned counsel appearing for the applicant/petitioner and Mr. S. Niranjan, learned GA appearing for the State respondents. [2] By the present MC(W.P. (C)) No. 328 of 2025, the applicant prays for interim relief by directing the Deputy Commissioner, Thoubal to issue status certificate of Lois/Scheduled Caste to the villagers of Nongpok Sekmai Lois Village, Thoubal District, Manipur. The prayer of the applicant is reproduced herein below: i. In the interim, interim, direct the Deputy Commissioner, Thoubal, to the issuance of the status certificates if he/she is satisfied to the subjection of disabilities of individual applicant Nongpok Sekmai Lois village i.e (1) Khumukcham, (2) Laishram, (3) Angom, (4) Khangembam, (5) Yumkhaibam, (6) Wangjam (Wangbajam), (7) Moirangthem, (8) Sinam, (9) Khwairakpam, (10) Yumlembam, (11) Ningombam, (12) Hidam, (13) Salam, (14) Ahongshangbam, (15) Keisham, (16) Asem, (17) Pangambam, (18) Huidrom, (19) Longjam, (20) Sapam and (21) Thangjam, after conducting the due enquiry in terms of the Hon'ble Supreme Court Judgment and order dated 09/10/1996 passed in Civil Appeal No. 14517 of 1996 reported in (1997) 2 SCC 523 during pendency of the final disposal of the instant writ petition; ii. to pass any appropriate other further order/orders/direction as may deem fit and proper to secure the ends of justice. [3] The learned counsel for the applicant submits that vide order dated 03.02.2025, passed by this Court in W.P. (C) No. 97 of 2025, it was stated that pendency of the writ petition shall not be a bar on the power of the Deputy Commissioner to issue caste certificate in terms of the Government notification and the same is reproduced herein below:
“[8] Recording the submissions made at the bar, it is clarified that the pendency of the writ petition shall not be a bar on the power of the Deputy Commissioner, Imphal East to issue caste certificate to the villagers of Kameng in terms of the Government notification” [4] The learned counsel for the applicant submits that the similar order may be passed in this present case also. [5] The learned GA for the State respondents submits that this Court may pass an appropriate order in the peculiar facts of the present case.
[6] This Court perused the materials on record and the submissions made at the bar, it is clarified that the pendency of the writ petition shall not be a bar on the power of the Deputy Commissioner, Thoubal to issue caste certificate to the villagers of Nongpok Sekmai Lois Village, Thoubal, Manipur in terms of the Government notification and as per rule. [7] With these observations, the present MC(W.P. (C)) No. 328 of 2025 is
disposed of. [8] List the W.P. (C) No. 569 of 2024 on 12.05.2025.
