Heard Sri Anuj Bajpai, learned counsel for petitioner and learned Standing Counsel for State. 2. Petitioner’s husband died before attaining age of Superannuation. Her claim of gratuity was rejected by Divisional Deputy Director of Education (Secondary), Bareilly way back on 24.06.2022. 3. Learned counsel for petitioner submits that now due to subsequent event i.e. a Government Order dated 14.06.2023, even claim of petitioner could be considered for grant of gratuity in the light of its paragraph 4 which is quoted below :- “उ्ሹ कके ्ቅम मम शशासन दशारशा सम्यक वविचशाररोपरशान्त अशशासककीय सहशायतशा पशाप मशाध्यवमक वविदशालय कके ऐसके वश्ቌक जजिनकके दशारशा सकेविशावनविवृजቈኌ हकेततु 58/60 विरቧኍय वविकल्प प्ቔ (वितरमशान मम 60/62 विरर) कशा विरण नहीሻ वकयशा गयशा हहै और उनककी मवृत्यतु 60 विरर कके पपूविर हरो गययी हरो , कके आजቦኌतोሦ करो तथशा ऐसके वश्ቌक जजिन्होሦनके 62 विरर पर सकेविशावनविवृजቈኌ कशा वविकल्प भरशा वकन्ततु वविकल्प पररविरतन कके जलए वनरशारररत अविजर कके पपूविर मवृत्यतु हरो गययी हहै, कके पररजिनोሦ करो दकेय गकेच्यतुटयी कशा भतुगतशान वकए जिशानके कशा वनणरय जलयशा गयशा हहै।” 4. Learned Standing Counsel submits that aforesaid Government Order does not contemplate to revisit the orders passed earlier. 5. In aforesaid circumstances, this writ petition is disposed of with an observation that petitioner will be at liberty to approach respondent concerned that whether even a claim rejected earlier could be revived in the light of aforesaid Government Order and thereafter, on basis of factual and legal issues, concerned respondent will take a reasoned decision.
