Petitioner had earlier approached this Court by filing Writ Petition No.35152 of 2024, which came to be disposed of with a direction upon the court concerned to examine the question of issuance of passport to the petitioner in view of criminal proceedings. The concerned court has rejected the prayer for grant of NOC on the ground that though petitioner has been summoned by the court repeatedly over the last several years but he is deliberately avoiding appearance before the court. The court concerned has, therefore, observed that petitioner despite being aware of the proceedings has avoided the proceedings and also suppressed such facts while applying for passport. The criminal proceedings are such that punishment of imprisonment for more than 2 years can be awarded, in the event charges are proved against the petitioner at the stage of trial. In that view of the matter, we refuse to interfere with the order of the concerned court. Writ petition, accordingly, is dismissed. It shall be open for the petitioner to apply afresh, based upon the outcome of pending criminal proceedings.
