1. This criminal appeal arises out of the judgment of conviction and
order of sentence dated 13.01.2023 passed by the learned Sessions Judge, South Bastar, Dantewada in S.T. No. 97/2020, whereby the appellant has been convicted and sentenced in following manner :- CONVICTION SENTENCE Under Section 307 of the Indian Penal Code Rigorous Imprisonment for 03 years with fine of Rs.500/-, in default of payment of fine to further undergo RI for 01 month. The prosecution story, in brief, is that on 05.06.2020 at around 7.30 p.m. in evening when victim was sitting in-front of his house accused started abusing him and stabbed with a knife in left side of stomach and when victim"s wife and neighbours rushed to help and save the victim accused also chased them to assault, victim was taken to District hospital Bijapur from where he was referred to medical college Jagdalpur, where he was discharged on
15.06.2020. This incident was informed by Rajanna Parske to Police station Bijapur, District- Bijapur after which the police has registered the First Information Report under Section 294, 506-B, 307 of Indian Penal Code was registered in Crime No. 63/2020 against the present appellant.
3. The learned Session Judge, South Bastar, Dantewada (C.G.) framed the charges under Sections 294, 506-B and 307 of the IPC against the appellant. The appellant denied the charges and pleaded no guilty for the offence. The prosecution has examined 08 witnesses in the present case. The appellant has not examined any witness. After appreciating the evidence and material available on record, the learned trial court convicted the appellant which is mentioned in opening paragraph of this judgment. Being aggrieved by the same, the appellant prefer this appeal.

Learned counsel for the appellant submits that the appellant has already served out the entire jail sentence as awarded to him by the learned trial Court for the offence in question and has been released therefore, he does not want to further press this appeal on merits.

5. In compliance of the Court’s order dated 17.03.2025, the Superintendent of Central Jail, Jagdalpur has informed this Court on 17.03.2025 that the appellant has already served out the jail sentence as awarded by the learned trial Court and has been released from jail.
6. In view of the same, nothing remains for adjudication in this appeal as the counsel for the appellant does not wish to argue the appeal further on merits. Accordingly, the present appeal is dismissed. Sd/-
