And 3 Others Counsel for Petitioner :- Sikandar Khan,Yusuf Ali Counsel for Respondent :- C.S.C.,Sher Bahadur Singh Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayers:
"a) Issue, a writ order or direction, in the nature of Mandamus directing the respondent no.2 and 3 to not interfere in the peaceful possession of the petitioners over their own land i.e. Plot No. 560 situated at Village Amkheda Lucknow, Pargana, Tensil Bisalpur District Pilibhit till the disposal of objection filed by petitioner dated 25.11.2024 pending before District Magistrate Pilibhit. b) Issue, a writ order or direction, in the nature of Mandaus directing the respondent no.2 to decide the representation/objection of the petitioner dated 25.11.2024 within stipulated period which may specified by this Hon'ble Court." The first prayer made in the writ petition cannot be granted. However, as an application has been moved before respondent no.2 on 25.11.2024 which is pending consideration, no useful purpose would be served in keeping the matter pending or issuing notice to the private respondent and the writ petition is being
disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- District Magistrate, Pilibhit to decide application dated 25.11.2024, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
