JUSTICE SOUMITRA SAIKIA ORDER 28.04 .2025 Heard Mr. Mr. Bhuyan, learned counsel has represented the petitioner on behalf of Mr. B. Gogoi, learned Addl. Advocate General and Mr. P. Nayak, learned Addl. Advocate General. Also heard Mr. R. Dhar, learned Addl. Senior Government Advocate for the respondents. The petitioner is before this Court praying for a direction to the respondents for release an amount of Rs.1,48,340/- an arrear dues to her late husband who was an employee under the respondent authorities and was expired on 24.01.2014. The said amount although sanctioned was deposited in the wrong account which is neither the account number of the petitioner nor her late husband. Although representations were filed the response were not forthcoming in response to the grievances raised by the petitioner. During the pendency of the writ petition the respondents have released the amount which the petitioner has received. The learned counsel for the respondents has placed before the Court the Page No.# 3/3 money receipt with due signature of the writ petitioner. That apart after release of the amount the petitioner has also communicated to the Additional Director General (COMM), Assam, Ulubari vide communication dated 06.06.2018 whereby she has acknowledged the receipt of an amount of Rs.1,48,340/- in cash towards arrear pay of Bill No.1753 dated 25.03.2015. By the said communication she has intimated the authorities that since the amount has been received she has no further grievance and that she will withdraw the WP(C) Case No. 2575 of 2018. The learned Addl. Senior Government Advocate appearing for the respondents therefore, submits that since the petitioner’s grievance has been redressed no further cause survives in the writ petition and therefore, the same may be closed. Mr. M. Bhuyan, learned counsel for the petitioner has also perused the said communication and therefore does not oppose to the submissions made by the learned counsel for the respondents. Accordingly, the writ petition stands closed. Interim order, if any, stands vacated. Pending Interlocutory Application, if any, is also dismissed.
