1. GP FOR CIVIL SUPPLIES (AP) The Court made the following: ORDER The above contempt case is filed complaining of violation of order dated 10.09.2014 passed in W.P.No.26655 of 2014
2. The petitioner, Fair Price Shop Dealer, filed the above writ petition complaining non-supply of the essential commodities as well as Kerosene Oil to his Fair Price shop. The said writ petition was disposed of directing respondents 4 and 5 therein i.e. the Revenue Divisional Officer, Gurajala, Guntur District and the Tahsildar, Piduguralla Mandal, Guntur District, to supply stocks to the petitioner’s fair price shop as long as the petitioner’s authorization is valid and subsisting. 3. In para No.4 of the affidavit filed in support of the contempt case, it was averred that the respondent failed to comply with the order dated 10.09.2014. 4. A counter affidavit was filed on behalf of the respondent. It was contended inter alia, that on the instructions given by the respondent vide Rc.No.1567/2014-B dated 30.09.2014, the Tahsildar, Piduguralla supplied essential commodities to the petitioner till April, 2015. Thereafter notice was issued to the petitioner pointing out irregularities and a case under Section 6A of the essential Commodities Act, 1955 was registered on 13.04.2015. The Deputy Tahsildar, Gurazala, issued a show cause notice to the petitioner vide Rc.No.540/2015-B dated 02.07.2015 calling for explanation, for which the petitioner submitted an explanation on 10.07.2015. Thereafter, by proceedings in Rc.No.540/2015-B dated 17.07.2015, the petitioner’s authorization was suspended, pending further enquiry. 5. Thus, as seen from the averments in the counter affidavit, in pursuance of the order, dated 10.09.2014, stocks were released to the petitioner’s fair price shop, till April, 2015 before suspending the authorization on 17.07.2015. Therefore, in the considered opinion of this court, the order dated 10.09.2014 in W.P.No.26655 of 2014, has not been violated. 6. Hence, this contempt case is closed. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
