Permission was denied by Sub Divisional Magistrate, Bazpur, District Udham Singh Nagar based on the report of In-charge Police Outpost, Sultanpur Patti of Kotwali Bazpur, District Udham Singh Nagar. 3. The In-charge Police Outpost, in his report has stated that no procession was ever taken out on the occasion of Barawafat, except in the year 2024 and that time, FIR was registered against certain persons for breaching public peace. 4. Learned State Counsel, by referring to the application made by the petitioner to Sub Divisional Magistrate submits that petitioner is a political person and he wants to draw political mileage out of the procession which he proposes to take out on account of Barawafat. He submits that the concern of District Administration is that there should not be breach of peace at the time such procession is taken out. 2025:UHC:7869 5. He further submits that taking of procession is not part of religious practice, therefore refusal of permission cannot be construed as interference with the religious rights of the petitioner. 6. This Court finds substance in the said submission made by learned State Counsel. 7. Having regard to the ramification which grant of permission may have on public peace, this Court refrains from making any interference in the matter. 8. The writ petition is, accordingly, disposed of. 9. Pending application(s), if any, stand disposed of.
