Mr. Abhishek Bahuguna, Advocate, for the petitioner. Mr. V.K. Kaparuwan, Standing Counsel, for the respondents. (2) Cantonment Board, Lansdowne, Pauri Garhwal granted permission to petitioner to run a canteen at Tip-in-Top Viewpoint. The said permission has been withdrawn by the order dated 28.8.2025. Thus feeling aggrieved, petitioner has approached this Court. (3) Principal ground for challenging the impugned order is that the petitioner was not given any notice or opportunity of hearing before withdrawing the permission. (4) Learned Counsel for the respondents concedes that opportunity of hearing was not given to the petitioner. He assures the Court that the order passed against the petitioner, which has been impugned herein, shall be withdrawn by tomorrow, however competent authority be granted liberty to pass fresh order. (5) Writ petition is, accordingly, disposed of by taking the statement made by Mr. Kaparuwan on record. Respondent no. 1, however, shall be at liberty to pass fresh order, but only after providing opportunity of hearing to the petitioner.
