Hon'ble Ms. Nand Prabha Shukla,J. 1.The present criminal appeal has been filed against the judgement and order dated 25.09.2007 passed by IInd Upper Sessions Judge, Fast Track Court No. 19, Bulandshahar in Session Trial No. 1026 of 1999 convicting and sentencing the appellants under section 302 read with 34 of IPC, Police Station Chhatari, District Bulandshahar to undergo R.I. for life and pay of fine of Rs. 5000/- in absence of payment of fine to further undergo R.I. for six months. 2. As per office report dated 22.3.2025 based on the report of Chief Judicial Magistrate, Bulandshahr dated 28.05.2024, both the appellants have died. In respect of appellant no. 1 Ram Prasad, S/o Chhiddu alias Chhida Singh, the statement of Mahesh, son of Ram Prasad and the statement of Nem Singh, nephew of Ram Prasad have been recorded in which they stated that the appellant-Ram Prasad died on 12.06.2014 during the treatment of illness. So far as the appellant no. 2 Chhutani alias Kshtrapal, S/o Nem Singh is concerned, the statement of Ved Prakash, son of Chhutani alias Kshtrapal and the statement of Bhanu Pratap, nephew of Chhutani have been recorded to the effect that he died because of illness on 08.08.2017. Copy of death certificates of both the appellants have also been annexed along with the report of Chief Judicial Magistrate, Bulandshahr. 3. Accordingly, the appeal stands abated in respect of both the appellants. 4. However, the record of the present appeal shall remain connected with Criminal Appeal No. 71447 of 2007.
