Neutral Citation No. - 2025:AHC:38675 Court No. - 4 Case :- WRIT - A No. - 19582 of 2024 Petitioner :- Umesh Chandra Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Rajneesh Kumar Sharma,Vinod Shankar Tripathi Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri V.S.Tripathi, learned counsel for the petitioner and learned Standing Counsel for the respondents. By means of present petition, filed under Article 226 of the Constitution, petitioner has prayed for mandamus commanding respondent authority to open the seal cover envelop and promote the petitioner from the post of Sub Inspector (Civil Police) to Inspector (Civil Police). Learned Standing Counsel has obtained instructions in the matter and placed the same before this Court, which is taken on record. As per instructions, the government order dated 28.5.1997 provides for opening of sealed covered only upon completion of one year period. At this stage, learned counsel for the petitioner submits that merely for pendency of civil suit against the petitioner sealed covere procedure ought not to have been adopted, but for that a prayer for a writ of certiorari for quashing the order placing the candidature of the petitioner under sealed cover as far as promotion is concerned, should have been made. In such above view of the matter, no writ of mandamus can be issued as such. The authority shall be under obligation to open sealed cover only upon completion of one year of which is going to be attained on 29.10.2024. Accordingly, I decline to grant indulgence in the matter at this stage, however, it is provided that respondnets will be opening sealed cover after one year period expires i.e. on 30th October, 2025 and will be doing needful in the matter accordingly. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 17.3.2025 Sanjeev Digitally signed by :- SANJEEV RANJAN High Court of Judicature at Allahabad
