Mr. Narendra Bali, learned counsel for the petitioner. 2. Mr. Rajeev Singh Bisht, learned Additional C.S.C. for the State of Uttarakhand. 3 Petitioner is serving as Teacher in a Government Primary School. He has been transferred from Government Primary School, Village Prahaladpur, Khanpur to Government Primary School, Halzor, within District Haridwar, vide order dated 09.08.2025. The charge against the petitioner is that he gave interview to a Digital Media Platform. 4. Learned counsel for the petitioner submits that although petitioner gave interview, however, he did not make any political statement and he simply highlighted the problems being faced by residents of the concerned Village, which, however, has been blown out of proportion for transferring him on administrative ground. 5. Learned State Counsel, per contra, submits that as per Conduct Rules applicable to Government employees, making statement on a Public Platform or Print or Electronic Media, including Digital Platform, is strictly prohibited. He submits that if Government Servant has any grievance, he must be highlighted within the mechanism provided under the applicable Rules. 2025:UHC:8009 6. Since this is the first time, petitioner has allegedly given any statement to the Digital Platform, therefore, a lenient approach may be adopted by the Competent Authority. 7. Accordingly, the writ petition is disposed of by permitting petitioner to make representation to District Education Officer concerned. If he makes representation within three days from today, decision thereupon shall be taken within two weeks thereafter. For a period of two weeks or till decision is taken by District Education Officer on petitioner’s representation, whichever is earlier, status quo qua petitioner’s posting shall be maintained.
