The petitioner has preferred the present petition with the following prayers:- a. Issue, a writ, order or direction in the nature of mandamus commanding and directing the respondents to pay the difference of gratuity amount calculating entire service period rendered by the petitioner's husband i.e. from 23.09.1982 to 05.07.2012 forthwith. b. Issue, a writ, order or direction in the nature of mandamus commanding and directing the respondents to pay the interest on the entire payment of gratuity at the rate of 18% per annum from the date of entitlement to till the date of actual disbursement. 2. It is argued that the controversy involved in the present petition is absolutely identical to the case of Shyama Devi Vs. State of U.P. and others (Writ A No.7235 of 2024) decided by this Court vide order dated 22.05.2024, therefore, the petitioner is entitled for the same relief. 3. Learned Standing Counsel prays for and is granted time till 20.01.2025 to seek instructions in the matter. 4. Put up as fresh before appropriate Bench on 22.01.2025.” 2. It is informed that due to heavy rush of pilgrims in Prayagraj City, Sri Kamal Kumar Kesherwani, learned counsel for petitioner, is not able to reach this Court. 3. I have perused the judgment passed by this Court in Shyama Devi vs. State of U.P. and others, Neutral Citation No. 2024:AHC:92893 and it appears that it is in favour of petitioner. 4. In view of above, this writ petition is disposed of with observation that claim of petitioner with regard to gratuity from 23.09.1982 to 05.07.2012 be considered in the light of aforesaid judgment within a short period and in case the facts of case are distinguishable and there is any legal impediment, the same shall be communicated to petitioner.
