GP FOR REVENUE 2 The Court made the following order: The present Writ Petition is filed questioning the proceedings in Rc.No.F1/26/2024, dated 02.01.2025, issued by the 4th respondent, rejecting to entertaining the application filed by the petitioner seeking to conduct survey over an extent of Ac.1.70 cents in Sy.No.332-2B and 332-3B of Vaddavalli Village, Sattenapalli Town and Mandal, Palanadu District. 2. A perusal of the proceedings dated 02.01.2025, it is clear that the 4th respondent cited reasons that a suit vide O.S.No.182 of 2016, is pending before the competent Civil Court. The counsel for the petitioner filed a copy of the judgment and decree in the said suit and says that the ground on which the 4th respondent rejected the application submitted by the petitioner, is bad in law. 3. In that view of the matter, the proceedings in R.C.No.FL/26337 of 2024, dated 02.01.2025, issued by the 4th respondent, is hereby set aside. The petitioner is directed to submit an application along with a copy of the judgment and decree in O.S.No.182 of 2016, before the 4th respondent. On receipt of the same, the 4th respondent shall consider the same and pass appropriate orders, in accordance with law, within a period of eight 3 (08) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. 4. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs. 5.
