Neutral Citation No. - 2025:AHC:27319 Court No. - 49 Case :- WRIT - B No. - 4671 of 2024 Petitioner :- Chandra Pal Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Indrakesh Kumar Sharma Counsel for Respondent :- C.S.C. Hon'ble J.J. Munir,J. Case called on. No one appears for the petitioner. Mr. Ashutosh Kumar Rai, learned Additional Chief Standing Counsel is present on behalf of the State. This matter has appeared in a bunch of fresh cases fixed for 10 am today involving common questions of fact and law or at least similar to one questioning the declaration under Section 4(1) and notification under Section 6(1) of the U.P. Consolidation of Holdings Act, 1953. The petitioner prays that a mandamus be issued to the Commissioner of Consolidation, U.P. to take into account his grievance and decide his representation dated 17.08.2024 within a specified period of time. The representation preferred to the Commissioner of Consolidation is not some kind of a statutory proceedings. The petitioner has not challenged any notification issued under the U.P. Consolidation of Holdings Act, 1953. We are not a recommendatory body like a Commission to recommend to one party, the Commissioner of Consolidation in this case, for favourable consideration the case of the other party to lis before us. This petition, which is merely one for a prayer to issue a direction to the respondents to decide a representation, is not maintainable. It is, accordingly, dismissed with liberty to the petitioner to seek such substantive relief as advised.
