The petitioner is apprehending his arrest in connection with CBI FIR No. RC 05(A)/2012-AHD-R, registered for the offences under Sections 420, 423, 424, 467, 468, 469, 471, 477-A, 120-B, 109 and 201 of the Indian Penal Code and Section 13(2) read with Sections 13(1)(d) of the Prevention of Corruption Act, pending in the court of learned AJC-XVIII-cum-Special Judge, CBI, Ranchi. 3. Ms. Khushboo Kataruka, learned counsel appearing for the petitioner submits that the petitioner was the evaluator of the examination conducted by the Jharkhand Public Service Commission in the year 2003. She submits that the said exam was investigated by the CBI on the direction passed in one W.P.(PIL). She further submits that the allegation is made that this petitioner has provided 09 extra marks to a particular candidate. She also submits that now the chargesheet has already been submitted and in view that the petitioner [2025:JHHC:22185] -2- may kindly be provided the privilege of anticipatory bail. 4. Mr. D.K. Bharti, learned Spl.P.P. appearing for the CBI has opposed the prayer and submits that the allegations are there against the petitioner, being the evaluator, of providing 09 more marks to a particular candidate in the examination conducted by the Jharkhand Public Service Commission. 5. Considering that the chargesheet has already been submitted and during investigation, it appears that the petitioner has co- operated in the investigation that’s why the CBI has not arrested him and only allegation is there against the petitioner, being the evaluator of the exam of providing 09 extra marks to a particular candidate, I am inclined to provide privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned AJC-XVIII-cum-Special Judge, CBI, Ranchi, in connection with CBI FIR No. RC 05(A)/2012-AHD-R, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
