The instant application under section 482 Cr.P.C. has been filed seeking quashing of the summoning order dated 12.9.2024 passed by the A.C.J.M. Court no. 2 Agra as well as the entire proceedings of Complaint No. 8344 of 2024 (Ms. India Traders Vs. Ms. Om Building Material and another) under section 406 IPC police station Chhatta District Agra. 3. Learned counsel for the applicant submits that there is commercial dispute between the applicant and the opposite party no. 2 due to which the instant case has been lodged by the opposite party no. 2 against the applicant. He submits that if an opportunity is granted there is every possibility of amicable settlement of the dispute between the parties. Learned counsel for the applicant seeks a direction for mediation before the trial court concerned. 4. In view thereof, the instant application is disposed of with a direction to the applicant herein to appear before the trial court concerned within a period of three weeks from today and upon such appearance the trial court concerned shall proceed with the trial in accordance with law. Thereupon if a request is made by the applicant herein before the trial court for referring the dispute to the mediation center, the said request shall be considered and decided in accordance with law looking at the bonafide of such prayer made by the applicant.
