… … Opposite Party ------ CORAM: SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Sidharth Sudhanshu, Advocate For the State : Mr. Prabir Kr. Chatterjee, APP ----- 06/ 14th July 2025
1. Heard the learned counsel for the parties.
2. This anticipatory bail application under Section 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred by the petitioner apprehending his arrest for offences registered under Sections 303 (2), 317 (2) of the Bharatiya Nyaya Sanhita along with Section 4 / 21 of the MMDR Act, in connection with Nirsa P.S. Case No. 431 of 2024, pending in the Court of learned Judicial Magistrate – 1st Class, Dhanbad.
3. Learned counsel for the petitioner submits that notices under Section 41A of the Cr.P.C., (35 (3) of the BNSS) has been issued against the petitioner. He further submits that he will appear before the Investigating Officer and thereafter, will take appropriate steps as till date warrant of arrest has not been issued.
4. Since notices under Section 35 (3) of the BNSS has been issued to the petitioner, a presumption can be drawn that police doesn’t want to arrest the petitioner. Thus, the petitioner should appear before the Investigating Officer and co-operate with the investigation and, thereafter, will take appropriate steps more so, when till date warrant of arrest has not issued.
5. Accordingly, this anticipatory bail application stands disposed of.
