PUBLIC PROSECUTOR The Court made the following: ORDER:- This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/A3, seeking regular bail, in Crime No.43 of 2025 of Kanchikacherla Police Station, NTR District. 2 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 318(2), 318(4), 64(1), 70(1), 127(2), 351(2), 87 r/w 3(5) of BNS. 3. The brief facts of the case are that the victim studying B.Tech Second year in Amrutha Sai Engineering College. A3 is classmate of victim. A2 developed acquaintance with victim girl when she used to going to college and hostel and thereafter, A2 used to follow her and saying that he is loving her and taken her to temples, restaurants and parks and at that time he took photographs of the victm girl. A2 introduced A1 to the victim girl and on 12.01.2025 at 11.00 a.m., A2 induced the victim that there was a function at his house and invited her for lunch and she believed the words of the A2 and came out from the hostel and thereafter A2 took her to his house and at that time, A3 and A1 were at his house and nobody present in his house and A2 took her into the house and went outside on the guise of some work and in the meantime, A1 locked the room threatened the victim saying that he has her photos with A2 and he would morphing the photos and posted in the social media and thereafter, he forcibly raped her against her will and the victim shouted loudly for help, the petitioner/A3 increased sound of T.V. with a view to neighbours were not hear the screaming of 3 the victim and A1 committed rape on the victim forcibly, A3 and A2 helped A1 in doing the alleged rape on her. The victim requested the petitioner as well as A2 to delete the photos in the phone and however, they threatened her with dire consequences and since then, A1 used to sending massages to the whatsapp number of the victim from his phone and demanded her to meet him otherwise he would posted the photos in social media and unable to bear the torture and threatening of the accused persons, the victim along with her parents approached police and lodged report against the accused persons. A1 to A3 conspired together and deceitfully called the victim to the house of A2 and helped A1 in committing rape against the victim and thereafter, the accused persons threatened the victim girl that they would post her necked photos in the social media and also video of rape in the social media. 4. Heard. Perused the record. 5. Learned counsel for the petitioner/A3 submits that police arrested the petitioner on 10.02.2025 and since he has been in judicial remand. Hence, prays to allow the petition. 6. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioner on the ground that the alleged offence 4 involved in this crime against the petitioner is severe in nature and the investigation has not been completed and prays to dismiss the petition. 7. After careful observation of the material on record and submissions made on behalf of both sides, the severe nature of allegations against the petitioner/A3 as he increased sound of T.V. with a view to neighbours not to hear the screaming of the victim, this Court is not inclined to grant bail to the petitioner at this stage. 8.
