ORAL ORDER (PER: HON'BLE MR. JUSTICE V SRISHANANDA)
1. Petitioners, respondent No.2 and injured Sri. Pampapati, are present before the Court.
2. Complainant-respondent No.2 who is represented by learned counsel Sri. Annaraya M. Patil, is present.
3. Learned HCGP appearing for the respondent No.1-State is present.
4. In respect of an unfortunate incident said to have occurred on 29.04.2015 at about 06.30 a.m., a complaint came to be lodged with Raichur West Police Station, based on an MLC report received from the Government Hospital, where under injured Pampapati and complainant-Manjula were taking treatment.
5. Police after thorough investigation filed charge- sheet against the petitioners. The petitioners and respondent No.2 unequivocally have admitted that, they have settled the dispute amicably.

6. Sri. Pampapati who is severely injured on his head is also present who also submits that, in order to put an end to the bad blood, at the intervention of the elders and well-wishers they have settled the dispute amicably and for the sake of certainty, a joint memo came to be filed before this court.
7. They also submit to the court that in view of the true settlement among the parties, the pending criminal case may be quashed.
8. The contents of the joint memo is explained to the parties and they unequivocally admit that the contents of the joint memo depicts the true terms of settlement and there is no force or undue influence or coercion in reaching out the settlement.
9. Even though offences alleged against the petitioners are non-compoundable and grievous in nature, taking note of the true settlement among the parties and a decade old litigation is being put to an end and the lis in privy to the parties and has no serious impact on the public

administration, this Court is of the considered opinion that the joint memo can be accepted and pending criminal case in S.C.No.14/2017 can be closed by quashing the charge sheet following the dictum of the Hon'ble Apex Court in the case of Ram Gopal S/o. Mansharam Vs. State of Madhya Pradesh, reported in (2023) 5 SCC 534.
10. Accordingly, the following order:
ORDER
(i) The joint memo dated 21.05.2025 is accepted.
(ii) Pending criminal case in S.C.No.14/2017 pending on the file of Principal Sessions Judge at Raichur, is hereby quashed.
