Neutral Citation No. - 2025:AHC:1283 Court No. - 5 Case :- WRIT - A No. - 19584 of 2024 Petitioner :- Mukesh Kumar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- R.K. Mishra Counsel for Respondent :- C.S.C.,Kaushalendra Nath Singh Hon'ble Ajay Bhanot,J. Heard Shri R.K. Mishra, learned counsel for the petitioner and Shri Kaushalendra Nath Singh, learned counsel for the respondent no. 2 and 3. Shri Kaushalendra Nath Singh, learned counsel for the respondent submits that the petitioner has been suspended on the footing that a disciplinary enquiry is contemplated against him for various acts of misconduct. Perusal of the suspension order shows that the charges are grave in nature which will warrant a major penalty if they are proved in the enquiry. Faced with this, Shri R.K. Mishra, learned counsel for the petitioner does not press the relief sought in the writ petition. He recasts his relief. The only prayer made by the
learned counsel for the petitioner is that the enquiry be completed within a stipulated period of time. Learned counsel for the petitioner also submits that he may be permitted to raise the grounds of malafide and tender the preliminary enquiry report dated 29.10.2024 as part of his
defence. In the wake of the preceding discussions, there is no cause for interference in the impugned order of suspension. The writ petition is disposed of with the following directions:
1. The enquiry proceedings shall be completed within a period of three months from the date of receipt of a certified copy of this order.
2. The petitioner is directed to cooperate in the proceeding.
3. The enquiry report may also consider the findings of the preliminary enquiry if raised by the petitioner in his defence as per law.
