Heard learned counsel for the petitioner and perused the record. 2. The instant petition has been filed for following relief: "i). Issue an order or direction to the Subordinate Court to expedite the hearing of and decide the Execution Misc. Case No. 01 of 2019, Smt. Vimala Shahi vs. Shambhu Nath and others, pending in the Court of Civil Judge (JD) Court No. 10, Deoria, within such stipulated period of time which this Hon'ble Court think fit to fixed for the same in this matter. ii.) Issue an order or direction to the Subordinate Court to hear and decide the and the Application No. 6-C filed for interim relief, within such stipulated period of time which this Hon'ble Court thinks fit to fixed for the same." 3. Contention of learned counsel for the petitioner is that execution case is pending since 2019. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to Court of Civil Judge (JD) Court No. 10, Deoria to consider and decide the Execution Case no. 01 of 2019, in accordance with law, expeditiously, preferably within a period of one year from the date of production of a certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
