According to him, he made application to the District Mine Officer, Bageshwar, seeking permission to use the debris/boulders, which are accumulated on the road due to landslides for construction of road and he assured that he would pay royalty for the material used for road construction. 3. Learned State Counsel submits that since petitioner has made a representation which is enclosed as Annexure-4 to the writ petition, therefore he has no objection if District Mine Officer, Bageshwar is directed to consider petitioner’s prayer. 4. Accordingly, writ petition is disposed of with direction to District Mine Officer concerned to consider petitioner’s request and take appropriate decision, as per law within ten days from date of presentation of certified copy of this order. 2025:UHC:7976 5. Permission, if granted, shall be with the condition that petitioner will pay requisite amount as royalty, to the State Government.
