Mr. Ravi Bisht, Advocate, for the petitioner. Mr. Dharmendra Barthwal, Advocate, for the respondents. (2) Petitioner claims to be owner of a house situate in Rukutt Compound, Nainital, which was constructed in 2022. Petitioner wants electricity connection, however, his application for electricity connection is not being entertained. By means of this writ petition, petitioner has sought the following relief: “i. Issue a writ order or direction in the nature of mandamus directing the respondent no. 2 to accept the Electricity form of the petitioner and to release a fresh Electricity connection in the name of the petitioner at the address on which connection is sought (i.e. Rukutt Compound, Mallital, Nainital) without any further delay, on such expenses or appropriate charges and fees as this Hon’ble Court may deems fit.” (3) Mr. Dharmendra Barthwal, on instructions, submits that since petitioner does not have valid title qua the land over which construction has been raised by him and there is a communication issued by Commissioner, Kumaon Division, in his capacity as Chairman, LDA, requesting the Uttarakhand Power Corporation Ltd. not to issue electricity connection to dissuade people from constructing house in that area. (4) Life without electricity cannot be 2025:UHC:8097 imagined and electricity has become a basic human right because of changing times. In such view of the matter, refusal on the part of UPCL to provide electricity connection to petitioner does not appear to be justified. (5) Writ petition is, accordingly, disposed of with a direction to Executive Engineer, Electricity Distribution Division, Nainital to entertain petitioner’s application and provide electricity connection to him, as per law, within ten days from the date of receipt of such application. However, petitioner shall not claim any equity based on this order and if his possession is found to be unauthorised, then the competent authority shall be at liberty to take appropriate action against him.
